Regulations circulated by the U.S. Department of Education to implement changes made to the Higher Education Act of 1965, as amended (HEA), by the Higher Education Amendments of 1998 require the disclosure of financial assistance and institutional information to students under the student financial assistance programs administered pursuant to Title IV of the Higher Education Act of 1965, as amended. These programs include the Federal Pell Grant Program and the William D. Ford Federal Direct Loan Program. Under the regulations, Hodges University must, on an annual basis, distribute to all enrolled students a notice of the availability of financial assistance and institutional information required to be disclosed pursuant to the HEA amendments and pursuant to the Family Educational Rights and Privacy Act (FERPA) which governs access to student education records maintained by educational institutions and the release of information from those records. Any person may report incidents of sexual misconduct regardless of whether the reporting party is the person alleged to have been the victim of such conduct.
In addition to the Title IX Coordinator, other employees are required by the University to provide information about sexual misconduct to the Title IX Coordinator. These employees, also referred to as Responsible Employees, are individuals designated by the University to respond on the University’s behalf to allegations of violations of Hodges University related polices. Responsible employees include the President, Executive Vice President of Administrative Operations, and the Senior Vice President of Academic Affairs.
An individual who reports an incident to a University employee that is not a Responsible Employee risks that the information may not be acted upon by the University. Therefore, a person who wishes for the University to act is strongly encouraged to report sexual misconduct to one of the offices listed above.
Anonymous Reports: Any person may make an anonymous report concerning sexual misconduct. Depending on the extent of information available about the incident or the individuals involved, the University’s ability to respond to an anonymous report may be limited. The Title IX Coordinator will determine any appropriate steps that can be taken on an anonymous report, including individual or community remedies as appropriate, and also to ensure compliance with all Clery Act obligations.
Please note that a Formal Complaint cannot be filed anonymously, and is only considered to have been filed only when the complaint contains the Complainant’s physical or digital signature, or otherwise indicates that the Complainant is the person filing the Formal Complaint.
Title IX of the Education Amendments of 1972 (Title IX) provides, “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.” Consistent with Title IX, Hodges University is committed to maintaining an educational and work environment free from unlawful discrimination and harassment.
In accordance with Title IX as interpreted by the United States Department of Education, the University has adopted a policy which prohibits discrimination on the basis of sex, and provides a formal grievance process to address violations. For this purpose, conduct will be deemed to have occurred on the basis of sex if such conduct occurred because of an individual’s gender, sexual orientation, gender identity and transgender status.
Title IX applies to any student, employee, or other individual that participates in a University program or activity in the United States, regardless of the individual’s sex, sexual orientation, enrollment or employment status, disability, race, religion, or national origin. All claims regarding sexual harassment, sexual/gender discrimination, sexual violence, or sexual misconduct should be filed in accordance with the University’s Title IX policy regardless of student or employment status.
